Welcome to Mekong General Electronics Supply Co., Ltd. (hereinafter referred to as “MGE”, “the Company”, “we”, “us”, or “our”). By purchasing our products or utilizing our services, you (the “Customer” or “User”) agree to be legally bound by the following terms and conditions.
1. Legal Acceptance
By accessing our website, purchasing MGE home appliances, or using our after-sales services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
2. Product Information and Pricing
- Accuracy: MGE strives to ensure that all product descriptions, technical specifications, and images are as accurate as possible. However, we do not warrant that such descriptions are error-free, complete, or current.
- Price Modifications: The Company reserves the right to modify prices and product specifications at any time without prior notice.
3. Payment Terms and Retention of Title
- Payment: Full payment is required before the dispatch of any products unless a credit arrangement has been formally signed in writing.
- Retention of Title: Notwithstanding delivery, the legal title and ownership of the products shall remain with MGE until the Company receives full payment in cleared funds for said products.
4. Limitation of Liability
- Indirect Losses: To the maximum extent permitted by law, MGE shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of data, or business interruption.
- Maximum Liability: The total liability of MGE for any claim arising out of or relating to a product shall not exceed the actual purchase price paid by the Customer for that specific product.
5. Intellectual Property Rights
- Ownership: All trademarks, logos (including the MGE brand), industrial designs, marketing materials, and software integrated into appliances are the exclusive property of Mekong General Electronics Supply Co., Ltd.
- Prohibitions: Customers are strictly prohibited from reproducing, modifying, or using our brand assets for commercial purposes without prior written authorization. Any unauthorized use of our “MGE” trademark will be prosecuted to the fullest extent of the law.
6. Warranty Policy and Disclaimers
- Limited Warranty: MGE products are covered by a limited warranty as specified in the warranty card provided with each unit.
- Warranty Exclusions: The warranty is strictly void under the following conditions:
- Damage caused by improper installation or misuse.
- Damage resulting from electrical surges, unstable voltage, or natural disasters.
- Use of non-authorized spare parts or third-party components.
- Repairs conducted by technicians not certified or authorized by MGE.
7. Force Majeure
MGE shall not be held liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, civil unrest, strikes, pandemics, government-imposed lockdowns, or international supply chain disruptions.
8. Indemnification
The Customer agrees to indemnify and hold MGE harmless from any claims, losses, or damages (including legal fees) arising from the Customer’s breach of these terms or the unauthorized modification of MGE products.
9. Dispute Resolution and Governing Law
- Governing Law: These terms shall be governed by and construed in accordance with the laws of the Kingdom of Cambodia.
- Amicable Settlement: In the event of a dispute, both parties agree to attempt an amicable settlement through good-faith negotiations within thirty (30) days.
- Jurisdiction: If negotiations fail, the dispute shall be submitted to the exclusive jurisdiction of the courts of Phnom Penh, Cambodia.
10. Amendments
MGE reserves the right to amend these Terms of Service at any time. The most current version will be posted on our official platforms and will take effect immediately upon posting.
